Can I go from litigation to an out of court process, if I am already in the court process?
Yes. you can go from litigation to out of court, so long as all the parties to the case agree. You cannot force another party to the case to abandon the lawsuit and seek an alternate form of dispute resolution (such as mediation or arbitration), but most of the time, parties to a case will agree to try ADR to resolve a case. After all, it can save everyone time and money.
