Will I go to jail if I get a DWI? Jail time is typically based on whether it is your first, second or third offense. For a first offense, there is no minimum jail time, a second offense could lead to 5 days in jail, or 30 days community service, depending on the length of time between the first and second offense, and a third offense could lead to 10 days in jail and 60 days community service if first two offenses were within the past five years.
