Re-certifying Your Pistol in D...

Re-certifying Your Pistol in Dutchess County

  • September 7, 2017

If you own a pistol in the State of New York and your license was issued before January 15, 2013, you will need to submit your re-certification by January 31, 2018. If your license was issued on or after January 15, 2013, the deadline to re-certify is five years after the date the permit was issued. While you can do the process yourself online, or mail it in (see the link below), you may want to have an attorney help you through the process to get it done correctly.

If you have any changes that need to be made to your permit, such as change of address, adding or removing a pistol or are selling your pistols, you will need to contact the sheriff’s office prior to re-certifying. Stenger, Diamond & Glass LLP (Stenger, Glass, Hagstrom, Lindars & Iuele LLP) can help you through the process, and be available for more complex, related issues.

Jessica Segal, and attorney at Stenger, Glass, Hagstrom, Lindars & Iuele LLP has helped several clients with related issues including how to make the status of your permit private, how to properly sell or transfer fire arms to non-immediate family members, how to have guns properly removed from their permits and what to do when your license has been suspended. “Today, families are fluid and there are specific requirements when making changes to your permit that are subject to prosecution if they are not followed properly,” informs Segal.

What if you inherit a pistol from a family member? Possessing a pistol, no matter how sentimental it is, (a 45 from a historic war, or a family hunting rifle) it can be a federal as well as a state felony if the transfer is not properly documented or held by a certain class of individuals.

Every state has very specific pistol laws and even with the passing of the NY SAFE Act in 2013, confusion is still at an all-time high. And now, if you own a pistol and live in York State, you will need to recertify your pistol permit.
